Read these Terms & Conditions (the “Terms”) thoroughly and carefully before a booking is made with us as these Terms & Conditions form the contract between yourself and Into the Vineyard Inc.

Agreement

The Terms are important as they, together with your booking confirmation email, govern the legal terms on which our travel services are made available to you. Into the Vineyard Inc.’s (“the Company”, “us”, “we” and the possessive “our” as applicable) services are provided to you (“you”, “yourself”, “participant” and the possessive “your” as applicable) through our website located at: intothevineyard.com and such other applications and online tools that we may use. Travel services refers to any bookings for travel, hotel accommodation, meals, insurance, tours, trips or other transactions, products that are provided to you, through our services and offered by a third-party supplier (the “Services”).

The Services are designed to assist you in providing travel information and to assist you in booking the Services. By using any of the Services offered by us and/or submitting payment for any of the Services, you accept to be bound by all of the Terms. If you do not agree to these Terms, then you must not use the Services of Into the Vineyard Inc.

Applicability of the Services and the Terms

If you use the Services to book travel services for yourself and/or on behalf of others, you agree that you will inform them about the Terms that apply to the booking and ensure they agree to the Terms.

You agree that in using the Services, you are at least 18 years of age and have the legal authority to enter into contracts.

We reserve the right to deny anyone access to our Services anytime for any valid reason, as permitted by applicable law.

Booking Process

Booking your trip involves two main steps:

The first step is to pay the Trip Development Deposit, as defined below, along with any additional deposits as set out in the Deposits and Final Payments section below. Upon receipt of payment, one of our skilled planning agents will work with you to create a tailored itinerary (the “Draft Itinerary”). This Draft Itinerary will encompass all your trip ideas and preferences.

After this initial step and based on your Draft Itinerary, we will provide you with our estimated costs for your trip and a non-refundable deposit of 30% of your entire trip will be required to commence the booking process. Upon receipt of payment, a booking confirmation email will be sent to you at the email address provided by you.

Payment

The payments applicable to the Services and your booking are as follows:

  • To engage our services, a fee will be payable (the “Trip Development Deposit”). The Trip Development Deposit is non-refundable and may be applied to your booking in the event you proceed with the Services.
  • A deposit in the amount of 30% of your entire trip cost is payable to commence the booking process for your trip (the “Trip Deposit”). The Trip Deposit is Non-Refundable.
  • At 90 days prior to your departure, the remainder of the payment (”Final Balance”) for your trip is due. If your Booking is made within 90 days of the Booking departure, the entire cost of the trip must be fully paid in order to receive your Confirmed Itinerary.

The Trip Costs are not guaranteed and may be subject to change at any time as a result of third-party changes outside of the Company’s control.

We reserve the right to correct any pricing errors on our Services. Any obvious errors made by us to your booking will be corrected by offering you with the opportunity to keep your booking by paying the correct price.

Estimates, Amendment and Third-Party Fees

Where a third-party supplier we have partnered with (the “Service Providers”) requests payments or fees from you in connection with your trip, we reserve the right to request these additional fees from you in advance of finalizing your trip details. (the “Third Party Fees”). If you request any amendments to the Draft Itinerary, there may be changes to the fees and charges charged by third parties or us in order to accommodate these amendments (the “Amendment Fees”).

The Third Party Fees and Amendment Fees will be provided to you in advance of making any changes to your Draft Itinerary and must be paid in before we issue your final itinerary (the “Confirmed Itinerary”).

If we have provided you with a quote for any particular Booking, it is based on tariffs, fees, taxes and costs in effect at the time you had contacted us and/or paid the Trip Deposit. While we work on your Booking, these rates can change and your quote may be different than the actual Booking costs, if inflation, costs of fuel, labour or materials, supplier costs, currency exchange rates, tariffs, government fees, and admission charges change. You acknowledge that any quote is merely a pre-estimate based on reasonably available information at that time, and acknowledge and understand that you will be required to pay the final Booking costs, regardless of any price increase from our initial quote.

Forms of Payment

Payments for the Services may be made by credit card, e-transfer, or wire transfer. If you would like to pay for the Trip Costs by wire transfer, please contact us to obtain our banking information. The Booking will not be confirmed until full payment has cleared, which may take several business days.

Cancellations by You and Refunds

To cancel your Booking, you must submit your request to us in writing by email at Info@intothevineyard.com or postal mail at Suite 212, 1807 Maritime Mews, Vancouver, BC Canada,V6H 3W7.

Based on the date we receive your written notification, cancellation fees will be applied per person, according to the following schedule:

  • Regardless of when you cancel your Booking, the Trip Development Deposit, the Trip Deposit (30%), any Additional Deposits, and any Immediate Non-Refundable Reservations (as defined below) are entirely non-refundable.
  • Cancelations up to 91 days prior to the Booking departure date: There is no refund for the Trip Deposit (30%), any Additional Deposits, and any Immediate Non-Refundable Reservations.
  • Cancelations from 90 days up to and including 31 days prior to the Booking departure date: 50% refund of the total trip cost.
  • Cancelations less than 30 days prior to the Booking departure: There is no refund or credit for any amounts paid (0% refund of full trip cost / 100% cancellation fee). 

The effective date of the notice of your cancellation will be the date of your email or the date the registered letter is received and signed for at the Into The Vineyard office as per the address above.

Immediate Non-Refundable Reservations have special cancellation terms and conditions different to what is outlined here. There may be non-refundable amounts associated with your cancellation which are above and beyond these terms. We will do our best to alert you to these at time of booking. Please refer to your invoice, where you will find your trip’s specific terms and conditions. Into The Vineyard has no control over these refunds. These are set by third parties and would be specifically and immediately non-refundable upon booking (the “Immediate Non-Refundable Reservations”). We will notify you of these instances in your Confirmed Itinerary.

No refunds of any type, including credit or replacement, will be provided for any unused portion of the Booking costs, for any reason, except in accordance with the terms set out above (the “Cancellation Policy”). There are no exceptions to this Cancellation Policy, including for Force Majeure as defined below. We strongly recommend you purchase trip cancellation and interruption insurance, and any additional insurance that may be appropriate for you.

Booking Start Date

It is your sole responsibility to be ready to embark on your trip on the dates specified in the Confirmed Itinerary. Into the Vineyard Inc. is not responsible for any losses, damages, delays, missed opportunities, or other penalties or fees due to cancelled or missed flights, changed flight itineraries, late arrivals, or early departures.

Health Requirements and Medical Care

You are responsible for determining what, if any, vaccinations or other health or safety precautions are necessary or recommended for your destinations. We are not physicians, and nothing we say should be interpreted as professional medical advice. Government health advisories can be found on the internet at:  http://www.cdc.gov and http://www.who.int

If you have a physical or medical condition, dietary restrictions, or other conditions that will require special attention, you must inform us in writing when the Booking is made as well as provide these details in your Traveller Information Form. We may require a medical certificate if you have a special condition.

Into the Vineyard Inc. assumes no responsibility for any medical care provided to you. You agree to assume all costs of medical care and related transportation that are provided to you during the Booking.

Changes by You

We will strive to accommodate change requests, to the extent we are able. If these requests require an extension of the trip, an increased number of persons, or the purchase of additional services, these amendments will be charged in addition to the original Trip Costs quoted to you. For any other amendment, a fee per person will be charged. Payment for these additional items must be paid fully in advance, but are subject to the same refund terms as the original Trip Costs.  Changes are subject to availability.

A fee will be imposed, if you change your trip dates or alter your itinerary after payment of the Trip Deposit. The fee will vary, depending on the type of change and the Service Provider. Hotels often impose additional fees or penalties for changes and cancellations. These are included in the change fee and can be substantial.

Services that will not be used (transfers and excursions) will not be refunded. Services that are voluntarily modified on the spot are subject to the Service Providers’ conditions. Additional services that entail an extra cost will have to be paid directly by the customer and Into the Vineyard Inc. will not be liable for these costs.

Cancellations or Changes by Us and Flexibility

We reserve the right to cancel, alter or modify any of the Services without prior notice for you and the Other Participants’ safety and/or comfort. You agree and acknowledge that the Services including but not limited to amenities, accommodations, transportation, route, schedule, and itinerary may change without prior notice due to Force Majeure (as defined below).

If, prior to the Booking departure, a significant change is made due to one of the factors above for services provided by a Service Provider, we will, as soon as reasonably possible, notify you of the alternative options that are available to you.

While no refund of any kind will be made because of Force Majeure, we will try and work with you to come up with alternative plans. Any additional expenses as a result of Force Majeure and alternative plans will be payable by you. 

No Refunds for Personal Expenses

Items and/or fees which are not included in the Confirmed Itinerary are considered to be personal expenses. You will not be reimbursed for any personal expenses due to changes in the Confirmed Itinerary.

Travel Insurance

The Trip Costs do NOT include travel, cancellation, or trip interruption insurance. We strongly recommend that you purchase comprehensive travel insurance, covering trip interruption and cancellation, baggage, medical, accident/life, evacuation, repatriation and other expenses which might arise as a result of loss, damage, injury, delay or inconvenience occurring to you.

If you are not a U.S. Resident, please speak to a travel insurance company in your jurisdiction to purchase the insurance coverage that is appropriate for you. If you are a U.S. Resident, you may purchase insurance through our preferred provider John Hancock Insurance. If you decide not to use our preferred provider, we assume you are securing protection through another insurance company of your choosing.

Platform

You will be provided with your Confirmed Itinerary in a digital format via the Oasis Travel Platform. The Confirmed Itinerary is your main reference point for all arrangements regarding your trip. You can choose to download it as a PDF prior to departure or use the Oasis app on your phone or tablet.

Pre-Departure Documentation

It is important that you carefully read all trip-related documents that you receive from us as soon as you receive them. It is your responsibility to contact us if any information is incorrect. We cannot accept any liability if you do not notify us of any inaccuracies within 14 days of your receipt of those documents.

Please ensure your traveller information and profile form for yourself and those travelling with you are completed in full to ensure your booking details are accurate. If you fail to submit this and other necessary documentation that is required prior to departure, we reserve the right to treat your Booking as cancelled and impose the cancellation fees described in these Terms.

Into the Vineyard Inc. shall not be held liable for any inconvenience due to the loss/theft of plane tickets at the customs or check-in, non-presentation, or presentation of documents (ID card, passport, visa, vaccination certificate, etc.) which have expired or have an insufficient period of validity or do not conform to the indications on the back. In case of a failed check-in, there will be no refund of the package fare. 

Passports and Visas

You are responsible for ensuring that all necessary travel documents are valid and effective and in your possession for the entire tour. Passports are required and should be valid for at least 6 months after your date of return. We suggest you apply for or renew a passport early.

We do NOT arrange for visas or other travel-related entry requirements on your behalf. Other required documents may include visas, permits, and vaccination certificates. You assume complete and full responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements. Visa and entry requirements may vary depending on your nationality, the length of your stay, and the purpose of your visit, among other factors. Visa information and visas can be obtained by contacting the Consulate or Embassy of the countries involved.

You are also solely responsible for any adverse consequences resulting from incomplete or defective documentation. While we may provide information or advice on matters such as visas, vaccinations, climate, clothing, baggage, and special equipment in good faith as a courtesy to you, we are not responsible for any errors or omissions as to the information provided.

Limitations of Liability

INTO THE VINEYARD INC. IS NOT RESPONSIBLE IF ANY CUSTOMER SUFFERS DEATH, ILLNESS OR PERSONAL INJURY AS A RESULT OF ANY FAILURE TO PERFORM OR IMPROPER PERFORMANCE OF ANY PART OF THE CONTRACT WHERE SUCH FAILURE IS ATTRIBUTABLE TO (I) THE ACTS AND/OR OMISSIONS OF THE CUSTOMER, OR (II) THOSE OF A THIRD PARTY NOT CONNECTED WITH THE PROVISION OF THE SERVICES, THE BOOKING OR CONFIRMED ITINERARY, OR (III) AN EVENT, INCLUDING FORCE MAJEURE,WHICH NEITHER INTO THE VINEYARD OR THE SERVICE PROVIDER COULD HAVE FORESEEN OR PREVENTED EVEN WITH DUE CARE.

SHOULD ANY CUSTOMER SUFFER ILLNESS, INJURY OR DEATH THROUGH MISADVENTURE ARISING OUT OF AN ACTIVITY WHICH DOES NOT FORM PART OF THE CONFIRMED ITINERARY, INTO THE VINEYARD DOES NOT ACCEPT ANY LIABILITY ARISING FROM THE AFORESAID SITUATIONS. INTO THE VINEYARD MAY NEVERTHELESS VOLUNTARILY OFFER GENERAL ASSISTANCE. HOWEVER, ANY ADDITIONAL EXPENSES INCURRED FROM THIS WILL BE PAID DIRECTLY BY YOU.

SUBJECT TO APPLICABLE LAW, IN NO EVENT SHALL INTO THE VINEYARD, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS OR THEIR RESPECTIVE SUCCESSORS AND ASSIGNS, BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, ANY LOSS OR DAMAGES IN THE NATURE OF OR RELATING TO LOST BUSINESS, LOST SAVINGS, LOST DATA AND/OR LOST PROFITS, REGARDLESS OF THE CAUSE AND WHETHER ARISING IN CONTRACT (INCLUDING FUNDAMENTAL BREACH), TORT (INCLUDING NEGLIGENCE) OR OTHERWISE. THE FOREGOING LIMITATION SHALL APPLY EVEN IF WE KNEW OF OR OUGHT TO HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES.

IF INTO THE VINEYARD WERE HELD RESPONSIBLE FOR ANY LOSS OR DAMAGE RESULTING FROM THE SERVICES OR THE BOOKING IT PROVIDES, IN NO CASE THE CHARGES OF THESE RESPONSIBILITIES OF THE COMPANY MAY EXCEED THE ACTUAL AMOUNT THAT YOU HAVE PAID FOR THE SERVICES AND YOU AGREE TO RELEASE THE COMPANY UNCONDITIONALLY AND ABSOLUTELY FROM ANY ADDITIONAL LIABILITY. THE LIMITATION OF LIABILITY REFLECTS THE ALLOCATION OF RISK BETWEEN THE PARTIES. THE LIMITATIONS SPECIFIED IN THIS SECTION WILL REMAIN IN FORCE AND WILL REMAIN BINDING EVEN IF THE INEFFECTIVENESS OF THE ESSENTIAL PURPOSE OF ANY LIMITED REMEDIES SPECIFIED IN THESE TERMS IS DETECTED. THE LIMITATIONS OF LIABILITY DEFINED IN THESE TERMS EXIST FOR THE BENEFIT OF INTO THE VINEYARD.

THIRD PARTY LIMITATION OF LIABILITY

These Terms, along with the terms and conditions provided by any of the Service Providers (including but not limited to airlines, hotels, etc.) also apply to your booking.

All of the Service Providers operate entirely independently of us and may have their own terms and conditions, which we strongly recommend that you read prior to accepting any of the services provided by the Service Providers. The relevant Service Providers’ terms and conditions may limit or exclude their liability to you in the event of death, personal injury, delay or loss / damage of personal possessions. Into the Vineyard Inc. will not be liable for any damages or losses caused by any of the Service Providers.

Force Majeure

Into the Vineyard will not be deemed in breach of this agreement or otherwise liable to you, by reason of delay in performance or non-performance of any of its obligations under this agreement to the extent that any such delay or non-performance is due to any Force Majeure. “Force Majeure” means any circumstances beyond the reasonable control of Into the Vineyard, including without limitation acts of God, terrorist activities, insurrection, explosion, flood, tempest, forceful wind, fire or accident, war or threat of war declared or undeclared, sabotage, civil disturbance, labor strikes, requisition, sickness, epidemic, pandemic, quarantine, government intervention, weather conditions, and unforeseen circumstances.

If Into the Vineyard Inc. and/or any of its Service Providers are affected by Force Majeure, they shall be entitled to, and may in their sole discretion, vary or cancel any itinerary or arrangement in relation to the your Confirmed Itinerary. If the circumstances of Force Majeure are temporary, Into the Vineyard may investigate the prevailing situation, and it remains the sole and absolute discretion of Into the Vineyard whether to proceed with the Confirmed Itinerary.

Participant Release and Assumption of Risk 

I understand and am aware that during the tour or any of the Services in which I will participate under the arrangements of Into the Vineyard Inc. and its agents, associates, affiliated companies, or subcontractors, certain risks and dangers may arise, including but not limited to the hazards of traveling in unsafe areas or under unsafe conditions, the hazards of traveling in politically unstable areas, the dangers of civil disturbance and war, the forces of nature, the negligent or reckless acts or omissions of, and/or the bankruptcy, insolvency or cessation of services by the Service Providers.

By using the Services and/or booking a tour with Into the Vineyard Inc., you acknowledge and agree that some activities or events on your tour may include or facilitate the consumption of alcohol and you undertake to behave in a responsible manner and abide by all local laws and regulations in the jurisdiction you are in.. You also undertake not to disrupt the enjoyment of others on the tour holiday with you nor to do anything to bring the reputation of Into the Vineyard Inc. into disrepute. Into the Vineyard Inc. will be entitled to recover from the offending party compensation for any damage caused by you or persons under your reasonable control to any third party property or persons and you agree to indemnify and hold Into the Vineyard Inc. harmless for any such costs, lawsuits, damages, or other fees as a result of your acts or omissions. Into the Vineyard Inc. also has the right to refuse the Services to any person on any Booking or as part of a larger group booking, if in their sole opinion that person could endanger the health, safety and enjoyment of others on the tour.

In consideration of, and as part of the payment for, the right to participate in such toursI have and do hereby expressly assume all of the above risks. The terms of this agreement shall serve as a release and express assumption of risk for myself, my heirs, assignees, administrators, executors, and all members of my family, including any minors accompanying me. I will indemnify and hold harmless Into the Vineyard Inc. for any costs, lawsuits, damages, or other fees claimed against Into the Vineyard by any of the foregoing persons.

I have read this entire agreement, and I am agreeing to it freely by using the Services and/or paying any of the Trip Costs . I understand that this is a legally binding contract. No other representations concerning the legal effect of this document have been made to me.

I have read and fully understand the provisions and the legal consequences of this Release and Assumption of Risk, have been given an opportunity to seek independent legal advice and have either sought or waive same, and I hereby agree to all its conditions, especially noting and agreeing to the portion of this provision that releases the Company and its agents, employees, officers, directors, associates, affiliated companies, and subcontractors, to the extent permitted by law, from liability for the negligent or reckless acts or omissions of the Service Providers.

Complaint Procedure

If you have a complaint in connection with your Booking, you must promptly notify the Service Provider or Into the Vineyard Inc. of the problem so that they can attempt to remedy the situation. Failure to do so within 3 days extinguish your ability to claim any potential compensation from Into the Vineyard Inc. Further, if you attempt to address the problem on your own without using this notice procedure, you immediately forfeit any right to claim potential compensation from Into the Vineyard Inc. and you assume responsibility for any added costs you may incur and forfeit any potential refunds.

If you have still not obtained satisfaction for your complaint after your trip, please send your complaint through registered mail, including all written evidence within 15 days after the end of your trip and we will endeavour to work with you to resolve the matter.

Compliance with Local Laws and Tour Etiquette

You must strictly comply with all local laws, respect local customs and culture, accurately assess your abilities, respect other trip members’ privacy, and follow the suggestions and advice of any assigned guide. The decision of the local guide or local supplier is final on all matters that may threaten the safety or interfere with the well-being of others.

During any tour, Into the Vineyard Inc. or the local guide/supplier has the right in its sole discretion to remove anyone a) who it judges to be incapable of meeting the demands and requirements of participating in the tour activities; or b) who it determines to detract from others’ enjoyment of the tour.

Severability

If any provision of this agreement shall be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render the agreement unenforceable or invalid as a whole. Such unenforceable provision will be replaced with one that is valid and enforceable and which achieves, to the extent possible, the original objectives and intent of the original provision.

Successors and Assigns

This agreement shall inure to the benefit of and be binding upon Into the Vineyard and the Participant and their respective heirs, legal personal representatives, successors and assigns.

Updating of Terms and Conditions

Into the Vineyard reserves the right to update and/or alter these terms and conditions at any time. It is your responsibility to be familiar with these terms and conditions. The latest terms and conditions can be found on the Into the Vineyard website https://www.intothevineyard.com/ You will be bound by the current version of the Conditions at the time you make Your Booking.

Applicable Law

These Terms and the Confirmed Itinerary are subject to the laws of British Columbia, Canada and you submit to the exclusive jurisdiction of the courts located in Vancouver, British Columbia, Canada for the resolution of any dispute under these Terms.

Merger

This Agreement is the final, complete and exclusive statement of the parties’ agreement on the matters contained in this agreement. It supersedes all previous negotiations and agreements.

Company Responsibility

Into The Vineyard Inc. does not own or manage any aircraft, accommodation, restaurants and other facilities used in conjunction with the tours arranged. While we have exercised care in booking accommodation, restaurants, trips and other facilities for you based on reasonable knowledge and references, we make no representations that such aircraft, accommodation, restaurants, and other facilities and services have been inspected, maintained, or are fit for the purposes for which they advertise or hold themselves out.
